The normal start for most fairy tales began with “Once Upon a Time”. Once upon a time, 13 colonies rejected Colonialism and Taxation without representation. A few men met gathered and wrote documents to define the idea of what most of the rest of the inhabitants of the colonies same as the way things should be. Was there strife amongst them? Absolutely! The colonies were divided into two sides; the Loyalists (those that believed in the Monarchies’ Full control of everything) and the Revolutionists (those that did not believe in the Monarchy). These men have been called the “Founding Fathers” or “Framers” of our country. Was the rejection of the monarchy’s rule without consequences? NO, there was discord amongst the colonies and the population due to their beliefs. Add to that the Monarch’s attempt at quelling the descension using force. The Separatists formed their forces and thus began the struggle for freedom and self-rule. After the War was over and the surrender of the Monarch’s forces, the work began to form a new form of government. The Framers had collectively written a “Declaration of Independence” before the war. Now the discussions began in earnest to form the new Government. They debated as to how the government should be controlled and discussed and argued over many items. The one thing they decided on was who should be in charge. They didn’t want another “King” but they didn’t believe in more than one leader. How could you fairly govern a country without giving all the power to just a few people? After several years they formed our government. Arguably it was a difficult task as you had 13 different colonies that wanted their share of the decision-making. What was decided was that each colony would be separate as a State. Those residing in those states would nominate and elect a representative to meet and discuss the needs of each state. Each state would have to do the same by forming a state government. In the new Government of the United States, a set of rules was formed to define how the government would operate. To create a system of checks and balances the government was to be divided into three branches. This was so that no one branch held all the power. The two main branches Executive and Legislative branches would be the branches that formed the laws and lead the country. The Third Branch, the Judicial, would make sure that the other two followed this set of rules (The Constitution of the United States).
The Legislative Branch: Made up of two bodies, The House of Representatives (The number of Representatives for each state to be determined by the number of legal citizens in each ) would debate how to use the people’s money to protect the citizens and the country. That Bill would then be sent to the other body, The Senate (only two Senators per state) for approval and additions or subtractions. If both bodies were in agreement on the contents of the legislation (Bill) then the Bill was sent to the Executive branch (The President) to be signed into law or Vetoed.
The Executive Branch: This is led by the President of the United States. He is the Commander and Chief of the military and the head of State.
The Third Branch, and written to be the weakest, was The Judicial Branch. The top body of this branch was made up of non-elected officials. The Justices would be nominated by the president and then the nominees would be confirmed by the Senate. The term was for life. The number was decided to be an uneven number to prevent a tie. The duty of this court was to examine each case that was brought to them to see if the law that was in question was applied correctly according to the Constitution. This branch’s only responsibility was to determine if the case before them met the requirements of the written document “The Constitution of the United States”.
“Once Upon a Time”, The judicial branch could ask the framers For the exact meaning of the content of the constitution. In modern-day, the only way to determine the intention is to read it, and all the debates by the framers to establish its meaning. The Supreme Court is not a Legislative branch, it is not intended to make laws or apply the individual Justices’ opinion of the Document the Framers wrote.
“Once Upon a Time” our government ‘Of the people, For the people, and By the people’ was genuinely concerned with the protection of the legal citizens of these United States. It made becoming a citizen the goal of people from all over the world. The path to that Citizenship and all the protections that a legal citizen should enjoy was and still is written in the Constitution of the United States. The Document every Member of Congress or member of this Government including The President has sworn to protect and defend from “ALL enemies both foreign and domestic”.
